Welcome to Rise Dental (“Rise Dental”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your use of:

- Our secure patient portal, web apps, and mobile applications;
- Any in-office digital services;
- Our communications channels—including email, telephone, and SMS/text messaging programs.
By accessing or using any of these Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Acceptance & Eligibility
By using the Services, you represent you are at least 18 years old (or have parent/guardian consent) and legally able to form binding contracts. If not, do not use the Services.
2. Scope of Services
Rise Dental provides clinical dental care in-office plus digital tools to schedule appointments, complete forms, make payments, access treatment plans, receive educational content, and communicate with our team. No content on the Services is a substitute for professional medical or dental advice. Always consult your dentist or physician regarding specific conditions.
3. Account Registration & Security
You may need an account for certain features. You agree to provide accurate info, maintain confidentiality of credentials, and promptly update changes. You are responsible for all activity under your account.
4. Appointment Management
- Scheduling & Confirmation: Online, by phone, or via SMS.
- Cancellations: Please give at least 48 hours’ notice to avoid cancellation fees.
- Missed Appointments: No-show fees may apply per our financial policy.
5. Payments & Insurance
All fees are due at the time of service unless arranged otherwise. Insurance estimates are not guarantees of payment; you’re responsible for any balances not covered by insurance.
6. Intellectual Property
All content on the Services—text, graphics, logos, videos, and software—is the property of Rise Dental or its licensors, protected by intellectual property laws. You may not copy, distribute, or create derivative works without prior written consent.
7. User Content
You may submit information (e.g., forms, reviews, messages). You grant Rise Dental a non-exclusive license to use that content to provide Services. You are responsible for ensuring the legality of any content you submit.
8. Third-Party Links & Integrations
Our Services may link to or integrate with third-party platforms (e.g., payment processors, Dental Intelligence). We do not control and are not responsible for their content, policies, or practices.
8A. Consent to Electronic Communications
By providing your contact information or using the Services, you consent to receive communications from Rise Dental electronically—including email, SMS/text messages, and portal/app notifications—for service-related and account-related purposes. These electronic communications satisfy any legal requirement that such communications be in writing.
9. SMS/Text Messaging Program
By providing your mobile number, you consent to receive SMS/text messages from Rise Dental regarding:
- Appointment-related messages: confirmations, reminders, check-in notices, day-of alerts, and post-visit follow-ups.
- Account & billing notices: insurance verification, billing statements, and payment links.
- Care guidance: treatment instructions, wellness tips, and educational resources.
- Practice updates & offers: occasional promotions, events, and holiday hours (only if you opt in).
Message frequency: Varies based on your interactions. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

To the fullest extent allowed by law, Rise Dental shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability shall not exceed $100 or the amount you paid in the 12 months prior to the claim.

You agree to indemnify and hold Rise Dental, its team, and partners harmless from claims arising from your violation of these Terms or misuse of the Services.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Texas. Any disputes will be handled in the courts of Travis County, Texas, and you consent to their jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be posted with a new “Last updated” date. Continued use of the Services after updates constitutes acceptance.
